Terms of Service
1.Acceptance of these terms
These Terms of Service (the “Terms”) govern your use of the
Kiosk Me In mobile application (the “App”) and the related
pages on the website at kioskitin.com (the “Site”), together
the “Service”. By installing or using the App, you agree to these Terms. If
you do not agree, do not install or use the App.
The Service is operated by Neha Yadav, an individual proprietor trading as “Floating Sage”, based in Mumbai, Maharashtra, India (“we”, “us”, “our”).
2.What Kiosk Me In is
Kiosk Me In is a platform that connects you with independent local businesses — salons, clinics, and similar service providers. Through the App you can discover nearby businesses, view their services, and book appointments, either in person or as a live one-to-one video appointment.
A booking you make is a request to a business. The actual services are provided by those independent businesses, not by Kiosk Me In. We are not a party to the agreement between you and the business, and we do not provide, supervise, or guarantee the services they deliver. Each business is responsible for its own pricing, availability, cancellations, conduct, and quality of service.
3.Eligibility
You must be at least 18 years of age to create an account and use the App. By using the App you confirm that you are 18 or older and that the information you provide (such as your phone number and name) is accurate and belongs to you.
4.Your account
You create an account using your phone number, verified by a one-time SMS code, and you provide your name (and, optionally, an email address for account recovery). You are responsible for the activity that happens under your account and for keeping access to your phone secure. You can delete your account at any time from Profile → Delete account in the App.
5.Bookings, payments, and no digital goods
When you book, you are requesting a real-world service — an in-person appointment or a live one-to-one video appointment — from an independent business. The App is not a marketplace for digital goods or digital content; nothing downloadable, no in-app virtual items, and no streamed media library are sold through it.
When prepaid bookings or paid video appointments are enabled, those payments are processed by Razorpay by UPI under its own terms, and any amounts relate solely to the real-world in-person or live video service provided by the business. We do not store your card or bank details. Rescheduling, cancellations, no-shows, and refunds for a paid booking are governed by our Refund & Cancellation Policy.
6.Acceptable use
You agree that you will not:
- Use the App to harass, abuse, threaten, or defraud a business or any other person.
- Make fake, abusive, or automated bookings, or impersonate someone else.
- Record, copy, or redistribute the audio or video of a video appointment without the consent of the other participant.
- Interfere with, probe, or attempt to gain unauthorised access to the Service or its backend.
- Reverse-engineer, decompile, or disassemble the App, except where the law expressly permits it.
- Use the App to violate any applicable law or the rights of any third party.
We may suspend or terminate your access if you breach these rules or misuse the Service.
7.Privacy
Our handling of personal data is described in our Privacy Policy. By using the App you also accept the Privacy Policy. If there is any conflict between these Terms and the Privacy Policy on a privacy matter, the Privacy Policy controls.
8.Third-party services
The App relies on third-party services to function — for example, Cloudflare (which hosts our backend), LiveKit (real-time transport for video appointments), Razorpay (payment processing, when paid bookings are enabled), your mobile carrier (SMS delivery), and the app stores. Your use of those services, and your dealings with the independent businesses you book, are governed by their respective terms. We are not responsible for the availability, content, or policies of any third party.
9.App updates and changes
We may release updates to the App from time to time. Some updates may add, change, or remove features. We may also revise these Terms; material changes will be reflected in the “Last updated” date above and announced inside the App. Continued use of the App after a revision constitutes acceptance of the revised Terms.
10.Disclaimer of warranties
The App is provided “as is” and “as available” without warranty of any kind, express or implied, including without limitation warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation.
We do not warrant that the App will be error-free, that defects will be corrected, or that the App is free of viruses or other harmful components. Because the services you book are provided by independent businesses, we do not guarantee the availability, quality, safety, or outcome of any appointment. You use the App and book at your sole risk.
11.Limitation of liability
To the maximum extent permitted by law, in no event shall Floating Sage, its operator, employees, agents, or affiliates be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including without limitation loss of profits, loss of data, or goodwill, arising out of or in connection with your use of or inability to use the App, or arising out of any service provided (or not provided) by an independent business you book, even if advised of the possibility of such damages.
To the extent any liability cannot be excluded by law, our aggregate liability for all claims arising out of or relating to the App in any 12-month period shall not exceed the greater of (a) the amount you paid us (not a business) in that period, or (b) one thousand Indian rupees (₹1,000).
12.Indemnification
You agree to indemnify and hold Floating Sage and its operator harmless from any claim, demand, loss, or expense (including reasonable legal fees) arising out of: (a) your use of the App in breach of these Terms; (b) your violation of any law or the rights of any third party; or (c) your dealings or disputes with any business you book through the App.
13.Termination
These Terms remain in effect while you use the App. You may end them at any time by deleting your account and uninstalling the App. We may terminate or suspend your use of the Service if you materially breach these Terms or if required by law.
Sections that by their nature should survive termination — including Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law — shall survive.
14.Governing law and jurisdiction
These Terms are governed by and construed in accordance with the laws of India, without regard to its conflict-of-law principles. Subject to the next sentence, the courts at Mumbai, Maharashtra shall have exclusive jurisdiction over any dispute arising out of or in connection with the Service.
Nothing in this clause limits any right you may have under the Consumer Protection Act, 2019 to bring a complaint before a consumer dispute redressal forum in your own jurisdiction, or under the DPDP Act 2023 to escalate a privacy grievance to the Data Protection Board of India.
15.Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will remain in full force. These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App, and supersede any prior agreement on the subject.
